Pay per Booking terms of use

By choosing to list on the Pay per Booking plan you agree to abide by the specific terms governing the use of this plan, namely:

DEFINITIONS

‘Commission’ - refers to the commission payable on any enquiries (bookings) that result in stays.

‘Gross Transactional Value’ (GTV) -  the GST inclusive amount you charge your guest for the stay including rental, extras (including cleaning, linen) and net of discounts.

‘Percentage Commission’ - refers to the percentage of GTV charged as a commission as published on our List a Property page (http://manage.bookabach.co.nz/list-a-property).

‘Conversion’ - is defined as the number of nights stayed over the cumulative nights provided.  It is expressed as a percentage.  For example if 100 nights were provided, and 50 nights converted to stays, then your Conversion of Bookabach bookings would be 50%.

‘Minimum Conversion Threshold’ - is defined as 10% of booking nights we provide over the past 6-months period.

1. ELIGIBILITY

The Pay per Booking listing plan available to all new listing customers and existing customers that meet our Minimum Conversion Threshold criteria.

2. USE OF CALENDAR

You MUST keep calendar up to date:  We rely on bookings being confirmed in order to bill the correct commission. You agree to keep your calendar up to date so that it reflects the true state of all bookings.  We reserve the right to cross check with our members or otherwise investigate where we feel a calendar is not being kept up to date to avoid payment of commissions.  We reserve the right to modify bookings that we know proceeded.  This includes, but is not limited to, converting questions to bookings, modifying booking dates and confirming bookings that proceeded.

3. PLAN CHARGES

3.1. Payment of commissions: You agree to pay a commission on all confirmed rental bookings obtained via our website or partner websites (affiliates or other) that result in a stay at your property.  This excludes any rental bookings you manually add to your calendar (external or manually added bookings) obtained from another source other than Bookabach.

3.2. Commission calculation:  The amount charged will be based on the percentage commission published at the time the enquiry was received.  Commissions apply to all bookings received via Bookabach, HomeAway or one of our marketing affiliates.  The total amount billed is calculated from Gross Transaction Value.  The commission is capped to a maximum number of nights for a long-term bookings (see below) and less any applicable account discounts, e.g. multi-listing discount. 

3.3. When charged:  Commissions will be charged to your Bookabach account the day after the final night’s stay with the exception of long-term bookings (see below)

3.4. Long-term bookings:  Bookabach charges a maximum of 21-nights commission on any one booking. On these longer-term rentals the commission is billed after the 21st night of stay.

3.5. Changes to commission percentage:  We reserve the right to change the commission percentage.  If we increase the commission percentage we will provide no less than 14 days notice to you.  You have the option to change your listing plan, suspend your listing or discontinue the use of the product.  You remain liable for all commissions payable on bookings received up until the time you discontinue use of the product or change plan.  The new commission would apply to any bookings lodged from the point of publication onwards.  Any bookings lodged prior to the commission percentage change will be billed at the old commission percentage - the one set at the time these bookings where received.

4. TERMINATION OF USE

You must meet our Minimal Conversion Threshold. We reserve the right to suspend your use of the Pay per Booking plan if; a) you do not meet the Minimum Conversion Threshold and we have provided at least 20 nights of booking enquiries in the past full 6-month period; or b)  where we have evidence that the Gross Transactional Value of bookings is being misrepresented. 

5. CANCELLATIONS AND REFUNDS

5.1. Last minute cancellations:  If a guest cancels at the last minute, or if a guest arrives later or departs earlier you have up to the currently scheduled departure date to modify the booking before our commission is calculated and charged. Failure to make this change will require you to make a request to our support desk to manually adjust the billed amount and will incur a nominal administration fee.

5.2. Commission changes and reversals: We will refund commissions charged if a stay did not go ahead or was not completed provided you follow our refund process.  This request must be made via email to our support desk. We will only offer refunds in the form of a credit to you member charges account. Our standard administrative fee applies to any refunds issued.

6. CHANGING PLANS

You can change from Pay per Booking plan to another plan at any time.  When you change plan you are still obligated to pay the commission associated with any booking requests you received while you where on Pay per Booking plan, up to the point in time you changed plan.

7. MOVING BOOKINGS

If you manage multiple properties you are able to freely move a booking from one property to another providing that that property is also listed on Bookabach. 

7.1. If you move a booking from a Pay per Booking property to an Annual Subscription property: The obligation to pay commission on the booking remains as the enquiry was received on the Pay per Booking listed property.  The commission will be based on the Gross Transactional Value of the booking.

7.2 If you move a booking from an Annual Subscription property to a Pay per Booking property:  You are not required to pay commission on this booking since the enquiry was received on the Annual Subscription listed property.
