TERMS AND CONDITIONS (TS & CS)
By booking this property, you agree to the following:
1. BOOKING AND CANCELLATION
1.1 The property is booked for the period of stay paid by you.
1.2 If you wish to cancel, you must give us no less than 5 days’ notice (before the check in time) and we shall refund to you all monies paid.
1.3 If you cancel less than 5 days in advance, the first night is non-refundable but 50% of the accommodation fees for remaining nights will be refunded. No part of the service fee or the cleaning fee will be refunded.
1.4 If you arrive and decide to leave early, 50% of the accommodation fees for the nights not spent 24 hours after the cancellation occurs are refunded. No part of the service fee or the cleaning fee will be refunded.
2. CHARGES TO BE MADE AGAINST CREDIT CARD
You shall provide us with the details of a credit card from which all charges and fees as set out in these Ts & Cs may be deducted by us.
3. SECURITY DEPOSIT
3.1 You shall pay the security deposit on making your booking.
3.2 The security deposit shall be applied towards repairs or making good any damage caused or arising during your stay, including damage to or replacement of any keys/remotes, furnishings, fixtures and fittings and any excess cleaning.
3.3 Nothing in this clause limits our rights to recover damages over and above the amount of the security deposit.
3.4 The security deposit less any deductions made in accordance with these Ts & Cs, shall be returned to you within 72 hours of you vacating the property.
4. CHECK-OUT
4.1 The check-out time is as stated in the booking particulars.
4.2 Unless we have agreed in writing to a late check-out or an extension of your stay, you shall vacate the property by the check-out time and take all your personal items with you.
4.3 Any personal items left by you at the property shall be deemed abandoned and shall be disposed of with no liability to you.
4.4 Any charges we incur in disposing of abandoned items shall be charged to the credit card.
4.5 If you fail to vacate the property by the check-out time, you shall be liable for an overstay fee of $500.00 which shall be charged to the credit card.
4.6 We shall re-enter the property any time after the check-out time.
4.7 On vacating the property, you shall return all keys and passes to the host. If you fail to do so, you will be charged for replacement keys and passes and your credit card debited.
5. GENERAL RULES OF CONDUCT AND USE OF PROPERTY
5.1 You have primary responsibility for your own safety during your stay at the property.
5.2 You shall inform the host immediately on becoming aware of anything which you believe is a health or safety risk.
5.3 You shall not smoke or allow any other person to smoke in the property or on the common area around the property.
5.4 You shall keep the property clean, tidy and clear of rubbish and leave it in the same condition as you found it at the commencement of your stay.
5.5 You shall take every care whilst using the fixtures, fittings, furnishings, electrical appliances, chattels, timber flooring, and benchtops so as to avoid any damage, dents or scratches.
5.6 On vacating, you shall ensure that all electrical and mechanical appliances are in proper and working order;
5.7 You shall use the property in a peaceful and safe manner being mindful and respectful of the interests of the occupants of the neighbouring properties.
5.8 You shall not access or attempt to access any cupboard, drawers or other area of the property which has been sealed with a locking device and you agree to pay a fixed charge of $500.00 for any breach of any tamper tape or device.
5.8 You shall not bring or allow any person to bring any pets or animals into the property;
5.9 You shall not do anything that will or might constitute a breach of any insurance policy in respect of the property;
5.10 You shall not obstruct or leave any objects or waste on the common property or outside of the property;
5.11 You shall not do or permit to be done on the property anything which is or which may become a nuisance, or cause annoyance, inconvenience or disturbance to any owner or occupier of the neighbouring property including but not limited to, playing loud music, banging, shouting.
5.12 You shall not conduct any illegal or immoral activity at the property;
5.13 You shall not make any modifications or additions to the property or its contents;
5.14 You shall not use the property for any purpose other than for personal residential accommodation;
5.15 You shall not have a party or gathering or more than 10 people without the host’s prior consent.
5.16 You shall not transfer or assign the use of the property, whether in whole or I part, to any third party;
6. PROPERTY DAMAGE
6.1 You shall notify the host of any damage to the property, its contents, fixtures or fittings which occurs during your stay, regardless of whether you believe you are not responsible for the damage.
6.2 If you fail to notify the host of such damage, it will be deemed to have been your responsibility and you shall be liable to make good such damage and your credit card charged accordingly.
7. INSPECTION
In cases of emergency, we may enter the property without notice to inspect and carry out or arrange necessary repairs.
8. EVICTION
8.1 If you breach any of the GENERAL RULES OF CONDUCT AND USE OF PROPERTY set out herein, you will be liable to be evicted at no notice.
8.2 The decision to evict shall be at the sole discretion of the host.
8.3 If you are evicted, you shall not be entitled to a refund of any portion of the monies paid by you.
9. GUESTS
Where more than one person makes the booking, the obligations arising from the booking including these Ts & Cs bind them jointly and severally.
10. NATURE OF ARRANGEMENT
The booking arrangement does not create the relationship of landlord and tenant and any such implication or inference is hereby expressly negatived.
11. LIABILITY
The host of owner of the property is not liable to you for any loss, damage or injury, however caused, which you, your agents, guests or invitees may suffer through the use of the property and you indemnify the host and the owner of the property against liability for any such loss damage or injury.
